Uploading Your Music

Royalties and Earnings

  • How do I get paid for my music? Jibu Music collects royalties from online stores and streaming services on your behalf and pays them out to you according to your chosen payout method (PayPal or M-Pesa).
  • How much money can I earn from my music? The amount of money you can earn from your music depends on a variety of factors, such as the number of times your music is streamed or downloaded, the price of your music, and the territory it is streamed or downloaded in.
  • What is the minimum payout threshold? The minimum payout threshold is USD 100. You will not receive a payout until your royalties reach this amount.
  • How often do I get paid? Royalties are typically paid out every quarter, once your earnings reach the minimum payout threshold.

Account Management

  • How do I update my account information? You can update your account information by logging into your account and clicking on the “Settings” tab.
  • Can I close my Jibu Music account? Yes, you can close your Jibu Music account at any time. However, you will not receive any royalties that have not yet been paid out.

Jibu Music Terms of Use

Introduction

Welcome to Jibu Music! These Terms of Use (“Terms”) explain the terms and conditions that apply to your use of the Jibu Music platform, app, service, websites, and software applications (collectively, the “Jibu Music Service” or “Service”).

By signing up for or otherwise using the Jibu Music Service, you agree to be bound by these Terms, our Privacy Policy, and relevant supplemental terms that apply to your interaction with each specific Service (collectively the “Agreements”). Please read these documents carefully.

Who can use Jibu Music?

You must be at least 18 years old and have the legal authority to enter into a binding contract with Jibu Music to use the Service. If you are under 18, you must have your guardian’s consent.

If you are opening an account on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to grant all permissions and licenses required under the Agreements and bind the entity to the Agreements.

Grant of Rights

By using the Service, you grant Jibu Music the following rights:

  • You grant us all necessary rights to sell and distribute your music recordings for digital downloads, streaming (both interactive and non-interactive), cloud services, and streaming-on-demand services. This does not transfer ownership of your recordings.
  • You grant us a non-exclusive, worldwide license to distribute, perform publicly, exhibit, broadcast, transmit, and make your recordings available online, including on all digital stores and similar media for sale, download, streaming, cloud services, and on-demand services, and for use with future technologies.
  • You grant us the right to sell, create promotional clips of, copy, and alter your recordings and metadata (information embedded in the audio file) as needed under these Terms. We can also sublicense or transfer these rights to digital stores.
  • You grant us the right to use your name, photos, likenesses, cover artwork, biographical information, and other information you submit to Jibu Music.
  • Jibu Music can sublicense or transfer the above rights to digital stores.
  • Jibu Music can make metadata corrections if necessary.
  • Jibu Music can synchronize your recordings with visual images, combine them with still or moving images, or stream them live.
  • Jibu Music can authorize third-party partners to create remixes or user-generated content using your recordings, such as on Twitch, TikTok, Facebook, and Instagram.

This does not transfer ownership of any materials you upload to Jibu Music.

Your Jibu Music Account

You need an account to access certain features of the Service. Creating an account is free. Using someone else’s account is not allowed. When creating your account, you must provide accurate and complete information.

You are solely responsible for all activity on your account and for maintaining the security of your password and any linked third-party services.

Please review our Privacy Policy for information on security, confidentiality, and how we use your data.

We strive to ensure our Services are available, but interruptions may occur. We will make reasonable efforts to correct them promptly. However, we are not liable for any errors, delays, or interruptions.

Your Music, Materials, and Information

When you upload recordings, you may also submit metadata and cover artwork. You submit these materials (collectively, “Materials”) at your own expense and in formats required by digital stores.

You are fully responsible for everything you submit. If we find it unsuitable, we may remove it and/or prevent you from using our Services or any digital stores.

You submit recordings in a pre-agreed format and release date, which cannot be changed.

We will do our best to perform the Services. However, Jibu Music is not responsible for any third-party failures in distributing your recordings or removing them, or for your failure to follow distribution instructions.

Royalties and Payouts

You keep 100% of your royalties earned from digital stores (unless you have royalty splits without a Jibu Music Pro or Label Subscription), with some exceptions:

  • Third-party aggregator fees
  • Applicable taxes
  • Payment and banking fees
  • Costs related to handling money and payments on your behalf

You are responsible for paying any other rights holders (producers, featured artists, etc.) and any applicable taxes.

Royalties from recordings monetized by Youtube Content ID are subject to a 20% commission fee on royalties accrued from February 2023 onwards.

Recordings subject to a split commission will not be charged a fee on YouTube Content ID royalties.

Your royalties are subject to the agreements Jibu Music has with digital stores. The price is determined by Jibu Music and the stores, at their sole discretion.

Stores report your royalties to Jibu Music, which are credited to your account quarterly These reports reflect royalties earned in previous months, as reported by the stores after Jibu Music receives payment from them. Each store has a delay (usually 2-6 months) in reporting your royalties.

  • You can request a payout when royalties are credited to your account. However, due to reporting delays, you won’t receive royalties during your first month(s) until Jibu Music receives reports from the stores.
  • Any net revenues are held in a bank account owned by Jibu Music, and you won’t receive interest or other earnings.
  • The minimum payout amount is USD 100 and cannot be paid out in parts. Your earnings accumulate until you reach USD 100.
  • The payout process takes approximately 1-7 business days.
  • Payouts are made through PayPal and M-Pesa. You must have an account with one of these services to receive royalties. Jibu Music reserves the right to add or change payout methods.
  • Jibu Music may withhold a payout if they suspect incorrect information, fraudulent or illegal activity, unauthorized account access, or if they suspect you uploaded infringing recordings.
  • Some countries may be restricted by the payout service, and Jibu Music cannot process payments to residents of those countries. Jibu Music is not liable if the payout service limits payments to your country. If you circumvent this or breach the payment provider’s terms, Jibu Music may withhold royalties and terminate your account.
  • Jibu Music can retroactively amend royalty payouts if a store reports an incorrect amount. Jibu Music assumes no liability regarding store reports.

Stores

Jibu Music partners with various digital stores to distribute your recordings. You choose the stores you want to distribute to. The agreements Jibu Music makes with stores determine the terms under which your recordings are sold or made available. These terms may change over time. Jibu Music cannot guarantee the sale or exploitation of your recordings in any particular store and assumes no liability if your recordings are not made available in a particular store or are taken down by the stores.

Jibu Music assumes no liability for interruptions, delays, errors, suspensions of access, reports, or payouts in the stores.

When you upload recordings, metadata, and other materials, we send them to the stores. You receive a locked release date that cannot be changed. Each store determines the delivery time for your recordings. We do not assume liability for store delivery times.

Royalty Splits

You can split royalties for a recording with other team members or receive royalty splits from other users’ recordings. Users without a Jibu Music Subscription pay a 20% commission on their share of royalties earned from recordings they are invited to or create (“Commission”). The commission is withheld on royalties earned during the non-subscription period. If you start paying for a Jibu Music subscription, you won’t pay the commission on royalties earned during your subscription period, subject to the Terms of Use.

You can add and edit royalty splits for new and previously released recordings. All invited users must accept and confirm splits before they take effect. Confirmed splits apply to royalties reported from the same month the splits were confirmed. For new recordings, all splits must be confirmed on the release date. Unconfirmed splits will revert to the owner of the recording.

Refund Policy

Jibu Music’s registration and subscription fees are non-refundable. Once an artist registers and subscribes to our platform, the fees paid are final, even if the artist later chooses to leave the platform. This policy ensures that all services provided during the subscription period are fully compensated.

Prohibited Use

You may not use the Service for any unlawful purpose or the following:

  • Illegal, infringing, or fraudulent purposes
  • Harming or attempting to harm someone

You may not upload recordings or materials that contain:

  • Hate speech, racism, or inflammatory content
  • Sexually explicit or violent material
  • Discrimination based on race, religion, nationality, disability, or sexual orientation
  • Promotion of illegal activity
  • Threats, harassment, or invasion of privacy
  • Impersonation of someone else

You also cannot upload the following types of recordings:

  • Covers of classical music
  • Podcasts, audiobooks, and radio shows
  • Parodies and tributes

Jibu Music can, in its sole discretion, determine if a recording or your actions violate these Terms or any other agreement. If a breach is found, Jibu Music may take actions they deem appropriate, including:

  • Temporary or permanent removal of your account, recordings, and materials
  • Withholding royalties
  • Freezing your account (you can still log in to see stream and royalty information and make payouts if you reach the threshold)

Third-Party Applications

The Jibu Music Service may integrate with third-party applications, websites, and services (“Third-Party Applications”) to make the Services available to you. These Third-Party Applications may have their own terms and conditions and privacy policies, and your use of them is governed by those terms. Jibu Music does not endorse and is not responsible for the behavior, features, or content of any Third-Party Application or for any transaction you enter into.

 

Term and Termination

Term: These Terms apply for as long as you use the Service.

Termination:

  • Jibu Music may terminate these Terms or suspend your access to the Service at any time, for any reason, with or without notice.
  • You may terminate these Terms by closing your Jibu Music account.

Effect of Termination:

  • Upon termination, your access to the Service will be terminated.
  • Jibu Music may delete your account and all content associated with it.
  • You will still be liable for any outstanding fees or charges.
  • Jibu Music may withhold royalties if your account is terminated due to a breach of these Terms.

Intellectual Property

Jibu Music owns the intellectual property rights in the Service, including trademarks, copyrights, patents, and trade secrets. You acknowledge and agree that all intellectual property rights in and to the Service are and shall remain the exclusive property of Jibu Music. You are granted a non-exclusive, non-transferable license to use the Service in accordance with these Terms.

Warranties and Disclaimers

Jibu Music Disclaimer: The Service is provided “as is” and without warranties of any kind, express or implied. Jibu Music disclaims all warranties, including but not limited to the warranties of merchantability, fitness for a particular purpose, non-infringement, and title. Jibu Music does not warrant that the Service will be uninterrupted, error-free, or virus-free. Jibu Music does not warrant that the results obtained by using the Service will be accurate or reliable.

Limitation of Liability: Jibu Music will not be liable for any damages arising out of or related to your use of the Service, including but not limited to direct, indirect, incidental, consequential, or punitive damages. Jibu Music will not be liable for any loss of revenue, profits, data, or business opportunities.

Indemnification: You agree to indemnify and hold harmless Jibu Music and its officers, directors, employees, agents, and licensors from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, arising out of or relating to your use of the Service or your violation of these Terms.

Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

Entire Agreement

These Terms constitute the entire agreement between you and Jibu Music with respect to the use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

Waiver

No waiver of any breach of these Terms by Jibu Music will constitute a waiver of any other breach.

Updates to the Terms

Jibu Music may update these Terms from time to time. We will post the updated Terms on the Jibu Music website. You are advised to review the Terms periodically for any changes. Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the updated Terms.

Jibu Music Africa (“Jibu Music,” “we,” “us,” or “our”) respects the privacy of our users (“you” or “your”). This Privacy Policy describes how we collect, use, disclose, and otherwise process your Personal Data (defined below) when you use our website (the “Site”) and all related sites, mobile apps, software, APIs, and other services provided by Jibu Music (together with the Site, “Service”).

  • Payment Data: PayPal/M-Pesa ID, tax information, and billing details processed by Stripe (our payment processor).
  • Fan Data: Email addresses of fans who follow creators on online stores and streaming services (shared with your consent).
  • Social Media Data: Profile and contact information you choose to share on our social media pages.
  • Online Activity Data:
    • IP address (for security)
    • Browser type and settings
    • Date and time of your visit
    • Pages visited
    • Referring website
    • Browser used

We retain your data for as long as necessary for the purposes listed in this Privacy Policy, to comply with legal requirements, or as long as we have a legitimate business need to do so.
